Terms of Service – EpiphyX

These Terms of Service ("Terms") govern your use of the EpiphyX application ("the App") operated by Epiphyllum Studio LLC ("we", "our", "us").

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the App.

1. Use License

Permission is granted to temporarily download one copy of the App for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the materials;
  • Use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  • Attempt to decompile or reverse engineer any software contained in the App;
  • Remove any copyright or other proprietary notations from the materials; or
  • Transfer the materials to another person or "mirror" the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Epiphyllum Studio LLC at any time.

2. Disclaimer

The materials within the App are provided on an 'as is' basis. Epiphyllum Studio LLC makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Further, Epiphyllum Studio LLC does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this App.

3. Limitations

In no event shall Epiphyllum Studio LLC or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the App, even if Epiphyllum Studio LLC or an authorized representative has been notified orally or in writing of the possibility of such damage.

4. Accuracy of Materials

The materials appearing in the App could include technical, typographical, or photographic errors. Epiphyllum Studio LLC does not warrant that any of the materials on its App are accurate, complete or current. Epiphyllum Studio LLC may make changes to the materials contained in its App at any time without notice. However, Epiphyllum Studio LLC does not make any commitment to update the materials.

5. Subscriptions

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.

6. AI Render Features

AI render features generate presentation images from user-provided design data, prompts, and optional reference photos. AI-generated output may be inaccurate, incomplete, or visually inconsistent with the underlying design.

AI renders are for visualization, sales, and presentation purposes only. They are not construction drawings, structural calculations, engineering documents, permit documents, or professional advice. You remain responsible for verifying designs, measurements, local code requirements, site conditions, and professional approvals before building.

You may not use AI render features to upload content you do not have rights to use, sensitive personal information that is not needed for the visualization, or unlawful, harmful, or abusive content.

7. Modifications

Epiphyllum Studio LLC may revise these terms of service for its App at any time without notice. By using this App you are agreeing to be bound by the then current version of these Terms of Service.

8. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the State of Washington and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
